EWRICON (ewricon.net) is an online tool of MARINCON GmbH & Co. KG (“MARINCON”) for professional customers in the shipping and marine industry. It provides indicative war risk premiums (hull & machinery, increased value, loss of hire) for areas listed by the Joint War Committee. Access is granted by MARINCON on request and may be refused or withdrawn at any time. These Terms of Use supplement the MARINCON Terms of Business; in case of conflict, these Terms of Use prevail for the use of EWRICON.
The account is personal. Login details must be kept secret and must not be shared with colleagues or third parties. You must provide correct registration data and tell us if it changes. Use of EWRICON is only permitted for your own business purposes or for the purposes of the company you represent.
All premiums, rates and values shown in EWRICON, including PDF indications, are indicative only. They are not an offer, quotation, cover note or confirmation of cover, and do not create any insurance cover or obligation to provide cover. Cover is only bound by a written confirmation from MARINCON or the underwriters. Rates depend on the information you enter, on the underwriters’ assessment, on the current JWC listings and on market conditions, and may change or be withdrawn at any time without notice. Indications may be subject to sanctions and compliance review, to underwriting information and to the underwriters’ final terms. Areas marked “on request” or “sanctioned” cannot be indicated.
You are responsible for the correctness and completeness of the data you enter (for example vessel, IMO number, insured values, voyage and areas). Incorrect data can lead to incorrect indications. If you request a quotation, you authorise MARINCON to pass the details of your enquiry on to insurers and co-brokers for the purpose of obtaining it.
The rates, the calculation logic, the content and the design of EWRICON are confidential business information and protected by law (including copyright and trade secret law). You must not:
What is expressly permitted: If you are a shipowner or manager, you may of course discuss indications for your own vessels (or vessels in your management) with the responsible employees of your company and with your existing insurance broker, to the extent this is needed for the insurance of those vessels. Please make them aware that the indication is confidential and non-binding.
EWRICON is live and in active use. The label “Beta” shows that we are continuing to develop the tool and add features, and that we welcome your feedback (info@marincon.de). Indications are prepared with the same care as our other work; the official quotation always comes from MARINCON (section 3). During the beta phase, screens, functions and the layout of documents may change.
EWRICON is provided free of charge and without guarantee of availability. MARINCON may change, interrupt or discontinue the tool or parts of it at any time, in particular for maintenance or to update rates.
MARINCON is liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory law requires. For slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment enables the proper use of the tool in the first place and on which you may regularly rely), liability is limited to the foreseeable damage typical for this kind of use. Otherwise MARINCON is not liable for slight negligence. Because indications are non-binding, MARINCON is in particular not liable for decisions taken in reliance on an indication alone. Liability under the German Product Liability Act is unaffected.
MARINCON may suspend or close an account at any time, in particular on suspicion of a breach of section 5. You can ask us at any time to close your account. Sections 3, 5 and 7 remain in effect after termination.
How we process personal data in EWRICON is described in the Privacy Notice EWRICON.
We may amend these Terms of Use with effect for the future, for example when the tool changes. You will be asked to confirm the new version on your next login. If you do not agree, you can no longer use EWRICON.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Hamburg.
